Shimla, Dec 3,
In a fresh escalation of the POCSO case against BJP MLA Hans Raj, the alleged victim has released an emotional video on social media accusing both the Congress-led Himachal Pradesh government and the BJP leadership of shielding the accused instead of ensuring justice. She said she felt “abandoned” by the political establishment, questioning how a fair investigation could take place when those in power appeared to be protecting the MLA. The victim said she was deeply distressed upon hearing that the MLA had allegedly received a phone call from the Chief Minister’s Office. “If the accused has access to the highest office in the state, how will I get justice?” she asked, saying such proximity to the government machinery had shaken her faith in the process. Her remarks come at a time when the investigation is already under public scrutiny due to concerns of political and administrative interference in a case registered under the Protection of Children from Sexual Offences (POCSO) Act. HimachalScape had earlier reported that MLA Hans Raj secured anticipatory bail, which was later confirmed by a Chamba court. The confirmation of bail has remained a contentious point, with critics arguing that it has allowed the accused to retain influence during the ongoing probe. The victim’s latest allegations have revived debate.
Alongside these concerns, the victim alleged she was facing sustained bullying and character assassination on social media, adding that attempts were being made to discredit her and weaken the case. She appealed to authorities to take strict action against online harassment, saying such intimidation had left her feeling unsafe and isolated.
The functioning of the state police and the Home Department has also come under sharp attention following the sudden transfer of an Additional Superintendent of Police who was overseeing the investigation. The timing of the transfer has triggered questions about administrative pressure on the probe and whether the investigation is being steered away from impartiality.
Amid this backdrop, the All India Democratic Women’s Association (AIDWA) has again demanded the immediate arrest of the MLA, arguing that his continued freedom could influence witnesses and intimidate the survivor. AIDWA has also called for the probe to be handed over to an independent IPS officer, saying the existing mechanism appears compromised. The survivor, in her message, expressed gratitude to AIDWA for supporting her “when everyone else turned away,” acknowledging their role during the political and social backlash she has been facing.
The case itself has been marked by controversy from the outset. An FIR was filed in 2024 after her family accused the MLA of sexually exploiting their minor daughter, but the police later submitted a closure report when the survivor retracted her statement in court. Despite this, allegations of pressure, inconsistencies, and political shielding have kept the matter alive in public discourse. Leaders across political lines have commented on the case in the past, but the current silence of both the ruling establishment and the opposition has only intensified public frustration.
The survivor’s new video has once again ignited widespread anger, with citizens questioning whether the institutions responsible for justice have failed to rise above political alignments. With the anticipatory bail, administrative transfers, and political silence all under scrutiny, demands for a credible, independent, and pressure-free investigation are growing stronger than ever.
