Himachal Pradesh Directorate of School Education has issued a clarification regarding the payment of arrears to lecturers who were granted deemed regular appointment following orders of the Himachal Pradesh High Court in the long-pending case of HP Lecturer Association & Others versus State of Himachal Pradesh.
In a communication issued by Director of School Education Ashish Kohli to all Deputy Directors of School Education (Secondary) and Principals/DDOs of Government Senior Secondary Schools, the department clarified the admissibility of arrears arising from the court’s directions in CWPOA No. 292 of 2020.
The order recalled that lecturers recruited against the 2008 requisition were granted deemed regular appointment from the date they joined service on contract through a speaking order issued on September 10, 2025.
The High Court had directed the State Government to extend notional benefits from the due date while restricting actual monetary benefits to three years preceding the filing of the respective petitions, along with all admissible arrears.
The department said several field offices had sought clarification regarding payment of arrears to impleaded petitioners who joined the litigation at different stages.
After seeking the opinion of the Learned District Attorney, the Directorate clarified that in such cases the period of three years for calculating arrears would be counted from the date on which the concerned petitioner joined the litigation, and not from the date of filing of the original petition.
The clarification has been circulated to ensure uniform implementation of the High Court’s directions across the state and to avoid discrepancies in the release of financial benefits.

The Directorate has directed all Drawing and Disbursing Officers (DDOs) to take necessary action in accordance with the clarification. It has also warned that any negligence or failure in implementing the instructions would make the concerned DDO personally responsible.
The order has also been endorsed to the Joint Controller (Finance and Accounts), the Learned District Attorney, the IT Cell for uploading on the departmental website, and other concerned authorities for further compliance.
