Hans Raj MLA POCSO case Himachal: Victim moves High Court, notice issued

The victim in the Chamba POCSO case has approached the Himachal Pradesh High Court by filing a criminal miscellaneous petition against BJP MLA Hans Raj.
According to court records, the matter titled XXX vs State of H.P. and others (Cr. MP(M) No. 71 of 2026) came up for hearing before the High Court on January 9. The petition has been filed seeking judicial intervention in connection with the ongoing investigation under the Protection of Children from Sexual Offences (POCSO) Act.
Senior Advocate B.L. Soni, appearing on behalf of the petitioner along with Advocate Nitin Soni, confirmed that the High Court has issued notice in the matter. He stated that notice has been served to the State respondents, and the court has also directed issuance of notice to the concerned private respondent, including the MLA.

During the proceedings, the Deputy Advocate General, representing the State, waived formal service of notice and sought time to file a reply/status report. The court granted four weeks’ time to the State to submit its response. Notice to the private respondent has been directed to be issued separately.
Advocate Soni said the matter is expected to be listed for further hearing shortly, once replies are filed. He declined to comment on the detailed grounds raised in the petition but indicated that the plea seeks appropriate judicial directions in the interest of justice.
The move to approach the High Court comes amid continuing controversy surrounding the case, in which the BJP legislator has already been granted regular bail by the Chamba court. The victim has earlier alleged intimidation, political interference, and irregularities in the investigation.
With the High Court now seized of the matter, the case has entered a new legal phase that could have significant implications for the ongoing proceedings.
