Himachal Pradesh High court upheld the order for disqualification pertaining to the ruling party councilor of Shimla Municipal Corporation Sanjeev Sood on the basis a complaint
This order was passed by the Division bench of Himachal Pradesh High court Comprising acting chief justice Ravi Malimath and justice Joytsana Rewal on Aug 17 allowed a writ petition filed by a Rakesh Kumar.
The petitioner moving in the HC stated that BJP nominated councillors Sanjeev Sood disqualified as MC member under sec 8(20 -r) f HP Muncipal Corporation act 1994 by the Director Urban Development. Director, Urban Development passed the order on the alleged submission of a false affidavit before the department during his nomination. Petitioner said that councillor has encroached upon the Government land and made an illegal construction of 5.25 square meter and was elevated as MC member. He also filed a complaint before the Urban Development director in the matter.
The respondent did not oppose the petition in the court or the order passed by the UD Director disqualifying him from the post allowed the petition directing the state to compile by the department forthwith, HC said in the final order .
