The Himachal Pradesh High Court has quashed a government order denying absorption of non-teaching staff from Shri Saraswati Sanskrit College, Dangar, District Bilaspur, directing the State to take over their services with retrospective effect from June 17, 2021.
Justice Sandeep Sharma, while allowing CWP of 2025 (Raman Kumar & others vs State of Himachal Pradesh & others), held that the petitioners—employed as Clerk, Darashanacharya and Peon since 2017–2018—were wrongly denied the benefit of takeover despite being eligible under Clause 7 of the State’s 1994 notification. The Court observed that the government had misinterpreted the clause by linking eligibility to the date of inspection rather than the actual takeover of the college.
Noting that the issue had already been settled by a Division Bench judgment in May 2024, the Court ruled that there was “no occasion” for the State to reject the employees’ cases afresh in January 2025. It ordered the government to regularize their services from June 17, 2021, grant all consequential benefits including arrears of salary, and complete compliance within six weeks.
Finding that the petitioners had been made to serve without pay since June 2021 and dragged into avoidable litigation, the Court also imposed costs of Rs 25,000 on the State, payable to the employees.
