Taking serious note of alleged encroachments and illegal constructions over forest and public land in Bangala Colony below Durga Gas Store, near SPM School, Sanjauli, the Himachal Pradesh High Court on Monday registered a Public Interest Litigation on its own motion.
The Court proceeded after receiving a representation highlighting rampant cementing of green areas, damage to existing deodar trees, burning of garbage on forest land and unauthorized occupation of public pathways. It was also pointed out that household waste-water is being discharged onto public paths and forest slopes and unregistered poultry structures have proliferated in the area.
A division bench headed by Chief Justice G S Sandhawalia issued notice to the State Government, the Deputy Commissioner and the Municipal Corporation, Shimla. Additional Advocate General Pranay Pratap Singh accepted notice on behalf of the State and Deputy Commissioner, while Advocate Mukul Sood appeared for the Municipal Corporation.
Observing the gravity of the allegations, the Court directed the Secretary, District Legal Services Authority, Shimla to visit the affected area and submit a report along with relevant photographs. The officer would be assisted by officials of the Deputy Commissioner’s office as well as the Municipal Corporation.
The Court also allowed the Deputy Commissioner to depute the concerned Sub Divisional Magistrate to carry out the inspection, if required.
Advocate Deven Khanna has been appointed Amicus Curiae to assist the Court in the matter. The Court clarified that if the allegations are found correct, authorities will be free to proceed against encroachers in accordance with law, after serving appropriate notices.
The matter has been listed for further hearing on September 17.
