The Himachal Pradesh High Court has ruled in favour of Dr. Divyanshu, a petitioner who sought parity with other selected Ayurvedic Medical Officers in availing time extension to complete her MD in Dravyaguna Vigyana from Chaudhary Brahm Prakash Ayurved Charak Sansthan, New Delhi.
Justice Sandeep Sharma, while allowing the writ petition, observed that the State’s stand denying the petitioner extension was unjustified since others in a similar situation were granted the benefit. “There appears to be no justification to deny similar treatment to the petitioner, who, taking note of the last date given in notification dated 15.03.2024, had no option but to join against the post in question,” the judge noted.
The Court held that the petitioner’s act of joining service on June 10, 2024, in compliance with the government’s order could not be used against her when other candidates, who chose not to join by that date, were subsequently given relief. Justice Sharma remarked, “Such of the candidates, who failed to adhere to the condition contained in notification dated 15.03.2024 with regard to last date of joining, have been given benefit of extension in joining time, whereas the petitioner, who, while adhering to the last date, joined the Department, is being denied such benefit.”
Quashing government communications dated February 15 and 21, 2025, the Court directed the State to permit the petitioner to complete her MD course by granting her extension in joining time “as has been done in the case of other similarly situate persons.”
The order clarified that any contract signed earlier by the petitioner would automatically stand cancelled, and she would be required to sign a fresh agreement upon rejoining, in line with the conditions imposed on other candidates.
Justice Sharma concluded with directions that the “needful shall be done positively within a period of two weeks,” expressing hope that the petitioner’s rightful claim, delayed for months, would now be settled fairly.
