Witness battle in high-profile Rajya Sabha Poll case: Himachal HC refuses to limit evidence

A development that could significantly shape the trajectory of the high-stakes Rajya Sabha election dispute from Himachal Pradesh, the Himachal Pradesh High Court has refused to curtail the scope of witness examination in the petition filed by Abhishek Manu Singhvi against BJP MP Harsh Mahajan.
The ruling effectively clears the way for a detailed evidentiary trial, rejecting Singhvi’s attempt to limit proceedings to a narrower legal question.
At the heart of the case lies the controversial Rajya Sabha election outcome, where Mahajan was declared elected after a rare tie was resolved through a draw of lots—a procedure now under judicial scrutiny. Singhvi’s petition challenges the manner in which the Returning Officer conducted and concluded the process, raising questions that could have wider implications for electoral procedures.

During the hearing, senior counsel Neeraj Gupta, appearing in the matter, argued that the dispute was primarily legal in nature and did not warrant the examination of a large number of witnesses. He submitted that the respondents’ extensive witness list was an attempt to prolong the proceedings and delay adjudication.
However, the High Court was not convinced.
In its order, the court held that election petitions inherently demand a comprehensive trial process. It emphasized that issues arising from such disputes cannot be conclusively decided without proper examination and cross-examination of witnesses, especially when procedural integrity and factual determinations are involved.
By dismissing Singhvi’s application, the court has underlined that the matter will proceed as a full-fledged trial rather than a limited legal adjudication.
The Registrar General has now been directed to move ahead with the witness list submitted by the respondents, and the process of recording evidence is set to begin. This means multiple testimonies will be examined in the coming hearings, potentially extending the timeline of the case but also ensuring a more detailed judicial review.
The outcome of this petition is being closely watched, not just for its immediate political implications in Himachal Pradesh, but also for the precedent it may set in handling election disputes involving tied results and procedural challenges.
