Himachal HC convicts law officer for contempt

On May 16, the Himachal Pradesh High Court issued a landmark ruling in the contempt case brought by M/s Vardhman Ispat Udyog against Kamlesh Saklani, a law officer at the Himachal Pradesh State Electricity Board (HPSEBL). This pivotal decision underscores the judiciary’s unwavering commitment to upholding the sanctity of court orders and the rule of law.
The court’s verdict was prompted by Saklani’s failure to comply with an earlier order in the case involving Vardhman Ispat Udyog. Despite his role in representing HPSEBL, Saklani neglected to disclose a stay order obtained by Vardhman Ispat Udyog, leading to accusations of deliberate defiance of court directives.
Saklani was given the chance to correct his actions, but the High Court found his apology insincere and lacking genuine remorse. The court noted inconsistencies in his statements and a failure to fully accept responsibility.
Justice Tarlok Singh Chauhan, who presided over the case, emphasized the critical importance of respecting court orders as the foundation of a democratic society. The verdict highlighted the judiciary’s duty to protect its authority and ensure the unobstructed administration of justice.
By convicting Saklani under Article 215 of the Constitution and Section 12(1) of the Contempt of Courts Act, 1971, the High Court made it clear that disobedience of court orders will not be tolerated.
