Five TGTs get Higher pay after HC order

Himachal Pradesh Education Department has issued an office order to re-fix the salaries of five Trained Graduate Teachers (TGTs) at the higher pay stage of Rs 41,600 after directions of the Himachal Pradesh High Court.
The order has been issued in connection with CWP No. 1249/2026, Jai Singh TGT (N/M) and others versus State of Himachal Pradesh, following the judgment in CWP No. 4830/2023, Inder Singh Thakur and others versus State of Himachal Pradesh.
The department has directed the concerned Drawing and Disbursing Officer to re-fix the pay of the petitioners after completion of two years of regular service and release the consequential arrears in accordance with the Finance Department’s instructions.
The benefit has been granted subject to the final outcome of the Letters Patent Appeal (LPA) filed by the department against the High Court judgment in the Inder Singh Thakur case. The Education Department has made it clear that if the LPA is decided in favour of the government, the teachers will be required to refund the excess amount paid to them.
The order states that an undertaking may be obtained from the beneficiaries to ensure recovery of any overpayment at a later stage. It also directs that if the benefit has already been released to any petitioner under an earlier order, double payment should not be made and the corresponding entry should be recorded in the individual service book.

The teachers were initially appointed as TGTs on contract basis in 2014 and were subsequently regularised. They completed two years of regular service in 2020 and had claimed the higher pay scale under the Finance Department notification dated September 6, 2022.
The five beneficiaries named in the order are Jai Singh, Gayitri Thakur, Satish Kumar, Rajeev Kumar and Shamsher Singh, who are posted in Kullu and Sirmaur districts.
The High Court had held in the Inder Singh Thakur case that the revised pay notifications dated January 3, 2022 and September 6, 2022 were applicable to the petitioners and directed the government to extend the benefits from the due dates and re-fix their pay accordingly.
