In a landmark decision, the High Court of Himachal Pradesh at Shimla has granted the first bail under the recently enacted Bhartiya Nagrik Suraksha Sanhita, 2023. The case, titled CRMP(M) 1434 of 2024, involved Baldev Singh, who sought relief under Section 483 of the new Act. The petitioner was charged under Sections 3(1)(r) and 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, and Sections 352 and 351(2) of the Bharatiya Nyaya Sanhita, 2023, based on an FIR filed on 1st July 2024.
During the hearing, Ganesh Barowalia, representing the petitioner, argued that the allegations were vague and lacked specificity, emphasizing the petitioner’s advanced age as a mitigating factor.
This ruling sets a precedent for future cases under the Bhartiya Nagrik Suraksha Sanhita, 2023, highlighting its implications for criminal justice in Himachal Pradesh and beyond.
