Solan consumer forum orders refund of Rs 32 Lakh to jomebuyers

The District Consumer Disputes Redressal Commission in Solan has directed Himalayan Dreams Villas Pvt. Ltd. and one of its authorised representatives to return Rs 32 lakh to two purchasers after the company failed to build and hand over a cottage for which the buyers had already paid the full amount.
The dispute arose after the buyers enrolled in a residential project at Anji village in Dharampur, Solan. Under the agreement, the developer was to provide a residential plot along with a two-bedroom cottage. The buyers claimed they paid Rs 32 lakh between 2020 and 2022, mainly from their retirement savings, expecting possession by the end of 2021.
According to the complaint, the promised construction never started despite repeated assurances from the developer. After several unsuccessful attempts to obtain either the cottage or a refund, the buyers served a legal notice and later approached the Consumer Commission for relief.

The Commission noted that the developer did not contest the proceedings despite being served notice. Based on the documents placed on record, including the agreement and proof of payment, it concluded that the company had failed to fulfil its commitments and was deficient in providing the promised service.
The Commission ordered the company to refund the entire Rs 32 lakh along with interest at 9 per cent per annum from the date the consumer complaint was filed until the payment is made. It also awarded Rs 30,000 as compensation for the inconvenience and mental distress suffered by the complainants and Rs 20,000 towards litigation expenses.
The complaint was filed by Ravneet Singh and another purchaser against Himalayan Dreams Villas Pvt. Ltd. and its authorised signatory before the Solan Consumer Commission.
