The dream of becoming a doctor for disabled student Nikita Chowdhary will now be fulfilled as the Himachal Pradesh High Court has ordered Dr Rajendra Prasad Medical College Tanda to admit her in MBBS.
A division bench of Justice Sabina and Justice Sushil Kukreja passed the verdict on the petition of physically disabled Nikita Chaudhary today.
A three paged order passed by the court noted that after the medical board of PGI Chandigarh certified her disability as 78 percent, she was eligible for admission to MBBS course.
The petitioner had challenged the decision of the Medical College to disqualify her from admission stating that due to Medical Council of India rule no students with a disability of up to 80 could be admitted to MBBS degree course.
It is worth mentioning here that Nikita, who is residents of Sarotri village in Kangra district, had cleared the NEET exam for MBBS on the first attempt. However Tanda Medical College had refused admission in MBBS on her disability ground, which they claimed was more than 80 percent.
It was after the High court took cognizance on the petition that the PGI Chandigarh medical board was ordered to issue a fresh medical disability certificate to the candidate. The PGI board found her disability at 78 per cent.
Petitioner also had procured a disability certificate from a Private Medical College Chandigarh which also found her 78 pc disabled. Wherafter the petitioner knocked the door of Himachal Pradesh High cout as the Medical College Tanda, had assessed her disability 90 percent and rejected admission.
Aggrieved Nikita also plead for justice by filing a similar petition before Principal of the medical college and top officials of the previous government. Remaining unheard she filed a petition in the High Court wherein Senior advocate Sanjeev Bhushan contested the case.
