HC hammers postings in Education Dept. Deputation orders stand cancelled

Himachal Pradesh Education Department has cancelled all deputation orders issued by the Directorate of Elementary Education, directing teachers and other officials to immediately join their respective places of posting from where their salaries are being drawn.
The order, issued in September by the Directorate of Elementary Education, follows directions conveyed by the Department of Personnel in compliance with an order of the Himachal Pradesh High Court dated June 15, 2026, in CWP No. 31 of 2024.
The department has made it clear that Drawing and Disbursing Officers (DDOs) cannot draw or release salary of any official against a station or post where the employee is not actually working. The DDOs have been directed to record a certificate on the salary bill confirming that the concerned officer or official actually worked at the station against which salary is claimed during the relevant month.
The government instructions dated May 1, 1999, provide that no salary bill should be passed without such certification. The latest order states that any deviation could render the concerned DDOs and district Treasury/Treasury and Sub-Treasury officers liable for disciplinary action under the applicable rules.
The Education Department noted that deputation orders relating to Lecturers (School), DPEs, TGTs, C&V teachers, JBTs and ministerial staff had been issued from time to time in public interest. However, in view of the Department of Personnel instructions issued pursuant to the High Court directions, such arrangements could not be continued.

Consequently, all deputation orders issued by the Directorate till date have been cancelled with immediate effect, and the concerned teachers and officials have been directed to report at their respective original places of posting.

The order, however, permits stop-gap or temporary arrangements made by Complex School Principals for a few days on a daily or weekly basis in teacher-less or single-teacher schools to continue. It also excludes officials deployed on election or census duty.
All controlling officers have been directed to ensure strict compliance, with personal responsibility fixed for any failure.
