The Himachal Pradesh High Court on Thursday reserved its decision in the matter of the complaint filed by Nishant Kumar Sharma alleging a ‘threat to life’ in the state and beyond. The case was scheduled for a hearing before the division bench of Chief Justice MS Ramachandra Rao and Justice Jyotsna Rewal Dua on Thursday informed advocate Neeraj Gupta.

Gupta, representing the petitioner, argued in court that an impartial investigation in this case would not be possible with the current Director General of Police (DGP) in office. The High Court directed both parties to present their respective submissions on the issue, and the court reserved its decision in the case.

Gupta informed that earlier, the Superintendent of Police (SP) of Shimla and SP of Kangra presented the status report of the investigation in court.

Background of the matter

Nishant Kumar Sharma had filed a complaint with the Kangra police against two unknown individuals who allegedly threatened him by blocking his path in Dharamshala’s McLeodganj. After the High Court took suo motu cognizance of the matter, an FIR was filed in McLeodganj, with a delay of 21 days. In his complaint, Nishant stated that there is a threat to his and his family’s lives.

According to Nishant, he was initially attacked in Noida on August 25th, resulting in injuries to himself and his two-and-a-half-year-old son. CCTV footage of the attack is available, and the Haryana Police are currently investigating the matter. Nishant believes that the Noida attack is connected to events in Himachal. Shortly after the Noida incident, his path was blocked in McLeodganj, and he faced further threats.

Noteworthy that in the matter, Sharma, the businessman from Kangra based in Noida, has an FIR pending against him in Chhota Shimla police station, filed on the complaint of HP-DGP Sanjay Kundu. Additionally, it is worth mentioning that another defamation case has been recently filed against Sharma in a Delhi court, connected to this matter.
