The Himachal Pradesh High Court has disposed of a petition filed by former MLA Hoshiar Singh after the State Assembly Secretariat assured that the process for releasing his pension was already underway and would be completed within two weeks.
A division bench comprising Justice Vivek Singh Thakur and Justice Romesh Verma took note of the assurance during the hearing and closed the proceedings after the petitioner’s counsel informed the court that the grievance stood resolved.
During the hearing, the lawyer representing the Assembly Secretariat submitted that, based on directions received from the Assembly Secretary on September 20, the formalities for sanctioning the monthly pension had been initiated. The Secretariat further apprised the bench that the necessary documentation and approvals from the Accountant General’s office were in progress and expected to be finalized within a fortnight.
Hoshiar Singh, who represented the Dehra Assembly constituency in Kangra district, had moved the High Court alleging that his pension had been withheld following his disqualification by the Speaker of the Legislative Assembly. Terming the action “illegal, arbitrary, and unconstitutional,” Singh argued that stopping his pension violated the provisions of the Himachal Pradesh Legislative Assembly Members’ Allowances and Pension Act, 1971.
He maintained that his resignation from the Assembly was voluntary and not a ground to deprive him of pension benefits. The petition also alleged that the decision appeared to be politically motivated, undermining his legal entitlements as a former legislator.
