A division bench of the Himachal Pradesh High Court has stayed a single judge’s order that had allowed former Union Minister and sitting MP Anurag Singh Thakur to participate in the upcoming elections of the Boxing Federation of India (BFI).
The bench, comprising Chief Justice Gurmeet Singh Sandhawalia and Justice Satyen Vaidya, passed the stay order after BFI President Ajay Singh challenged the earlier decision.
Previously, a single judge had directed the BFI to consider the nominations of both Anurag Thakur and Rajesh Bhandari as valid for the electoral college.
The court had also asked the BFI to proceed with the election process as per its rules and regulations, while staying the finalization of the electoral college list as an interim measure. It had further ordered the BFI to extend the last date for filing nominations, enabling Anurag Thakur to submit his papers.
However, Ajay Singh, challenging this decision, contended before the division bench that the interim order should be stayed. He pointed out that Anurag Thakur’s nomination had earlier been canceled based on a notice issued by the BFI on March 7.
The notice had specified that only genuine and duly elected members of state units affiliated with the BFI could represent their respective states in the upcoming elections. On these grounds, Thakur’s nomination, made by the Himachal Pradesh Boxing Association, was rejected.
The Himachal Pradesh Boxing Association, on the other hand, argued that the BFI President had no authority to impose conditions not explicitly mentioned in the federation’s rules and regulations.
They maintained that the cancellation of Thakur’s nomination was unjustified and contrary to the norms governing the electoral process.
With the division bench now staying the single judge’s order, the situation surrounding the BFI elections remains uncertain. The main petition and Letters Patent Appeal (LPA) are still pending before the High Court and are scheduled for further hearing on June 4.
This development has added another layer of complexity to the BFI election saga, with legal battles running parallel to the electoral process. All eyes are now on the June 4 hearing, which is expected to be crucial in determining whether Anurag Thakur will eventually be allowed to participate in the federation’s elections.
