Illegal Mining continues unchecked in Kangra; High Court questions Police role

The Himachal Pradesh High Court has expressed serious concern over the unabated illegal mining in Kangra district, casting aspersions on the functioning of the local police and enforcement machinery.
Hearing a public interest litigation (CWPIL No. 86 of 2024), the court observed that the status report submitted by the Superintendent of Police, Kangra, “does not inspire confidence” and appears to evade core issues already admitted in earlier filings.
The court noted that while authorities have issued challans to a large number of vehicles involved in illegal transportation of minerals, there is little evidence of consequential action. Despite provisions under the Himachal Pradesh Minor Minerals Rules that empower authorities to seize and confiscate vehicles and equipment used in illegal mining, such measures have not been effectively enforced.
Taking note of an adverse report by the Legal Services Authority, the court remarked that rampant illegal mining continues in the region, a fact also acknowledged in earlier affidavits filed by local administrative officials.
The bench, headed by Chief Justice G. S. Sandhawalia and Justice Bipin C. Negi, observed that the existing legal framework provides sufficient authority to act against offenders. However, the lack of stringent follow-up action raises questions over the intent and efficiency of the state machinery, particularly the Kangra police.
Emphasising accountability, the court directed the state government to file a comprehensive affidavit detailing specific actions taken under the relevant rules, including seizure, confiscation, and prosecution in cases of illegal mining.
The matter has been listed for further hearing on May 26, 2026.
