Kangra businessman alleged ‘threat to life’ matter: Complainant expresses dissatisfaction on the police investigation

In the Kangra resident businessman alleged ‘threat to life’ matter the complainant expressed dissatisfaction with the State Police probe in the Himachal Pradesh High Court on Wednesday. A hearing was held by the division bench of Justice MS Ramachandran Rao and Justice Jyotsna Rewal Dua on the complaint of businessman Nishant Sharma.
The counsel for the state of Himachal Pradesh stated that the status report of the case had been submitted, indicating that the Kangra Police had registered an FIR in the matter as per the direction of the high court.

Amicus curiae and counsel for the complainant, Neeraj Gupta, expressed his dissatisfaction in court regarding the police investigation so far. He stated that the culprits should have been interrogated in this case, and despite registering an FIR, those who had made threats had not been identified.
During the hearing, the counsel for the complainant said that the police probe could not be trusted, and the court should order the constitution of an SIT to investigate the case.
The complaint mentioned in court that he was not satisfied with the security cover extended to him following the court’s direction.
During the hearing, when the court orally suggested that this matter should be investigated by a senior officer, the counsel for the state said that the matter would be investigated by an ASP rank officer. The state also assured to strengthen the security cover for the complainant. The same has also been confirmed by advocate general Anup Rattan in a media statement.
The complaint also stated in court that he had not been supplied a copy of the proceedings of the investigation report after the FIR by the Kangra police. The High Court instructed the state to supply the copy of proceedings of the investigation after the registration of FIR to the complainant and counsel for the complainant as well.
The Chief Justice stated in court that during the previous hearing, the court had not ordered the filing of an FIR against the DGP. However, the court order was misquoted, attributing the media report without going through the facts. The Chief Justice indicated that the media should restrain from conducting a trial in this case and should present the facts as per the order of the court. The next hearing of this case will be on December 4.
The same was reiterated by the Advocate general in the media statement.
It is noteworthy that after the High Court took cognizance in this matter on November 11, an FIR was lodged in McLeodganj, Dharamshala, on the complaint of the businessman.

According to an earlier police press release an FIR under sections 341, 504, 506, and 34 of the Indian Penal Code (IPC) has now been registered in this case. Section 341 of IPC has been imposed for wrongfully blocking the way, Section 504 for abusive words, Section 506 for criminal intimidation and IPC Section 34 for involvement of two or more people.
Now reportedly, the police have taken footage from eight CCTV cameras in Bhagsunag. Using this lead, the police claim to have identified the accused.
Noida businessman Nishant, who hails from Himachal, was threatened by some people by blocking his path in Bhagsunag on October 27. He complained about this to the Kangra Police on October 28. However, the police did not register an FIR on Nishant’s complaint.
It was only after the court took cognizance that an FIR was registered in this matter. In the complaint given to SP Kangra, Nishant has stated that there is a threat to his and his family.

The businessman had also claimed that on August 25, there was a fatal attack on him and his family in the courtyard of their house in Noida. Nishant and his two and a half-year-old son were injured in this attack. CCTV footage was also available. Haryana Police are already investigating this matter.
Earlier Nishant had said in a press conference that the accused in the Noida attack has links with retired bureaucrats from Himachal. Therefore, after Noida, on October 27, he was also threatened by blocking his way at Bhagsunag in Dharamshala.
Here it pertinent to mention that HP DGP Sanjay Kundu has lodged an FIR in Chhota Shimla against this businessman. The FIR was done in response that after the alleged Bhagsunag incident, Nishant stated in the complaint to SP Kangra that DGP Sanjay Kundu called him repeatedly to Shimla. Also similar calls were also received from other local police officers to Nishant, he added in his complaint.
