The Session Court in Dharmshala delivered a verdict acquitting four individuals, including a German national residing in India, in a triple murder case that had gripped the region for nearly a decade. The case, which involved the brutal killings of three members of a family along with allegations of robbery, saw Baljinder Singh, Lakhvinder Singh (both siblings), Balveer Rana, and Surjeet Singh incarcerated for six to eight years before their exoneration.
Advocate Sunil Mallan, representing the respondents , emphasized the court’s decision to absolve all four accused of any wrongdoing after an exhaustive legal battle. Central to the defense’s argument was the suspicion raised regarding the involvement of the complainant himself in the crime, a claim that gained traction during the trial.
The trial proceedings revealed a lack of concrete evidence linking the acquitted individuals to the crime scene, as underscored by the testimony of the Forensic Science Laboratory (FSL) expert, whose report failed to establish any incriminating presence. Moreover, it became apparent that the chargesheet filed against them in 2018 lacked substantive proof to sustain the allegations leveled against them.
The genesis of the case lay in a complaint lodged at the Indora Police Station, alleging the murder of three family members and the subsequent disappearance of valuable assets. However, the defense contended that the complainant fabricated a narrative to implicate Baljinder Singh and others in a bid to seize their property, resulting in their wrongful imprisonment.
Hailing from Amritsar and Pathankot in Punjab, the acquitted individuals found respite through the diligent advocacy of attorneys KK Sen and Nishant Jamwal. With their vindication secured, the legal team now sets its sights on seeking damages against the complainants for the years of suffering endured by the innocent accused while the true perpetrators remained at large.
The court’s verdict not only exonerates the wrongfully accused but also underscores the imperative of upholding justice through diligent legal scrutiny and the pursuit of truth.
