The Himachal Pradesh High court amended the capital punishment of a POSCO convict into life imprisonment while hearing an application for remission of death’ sentence on Friday.
The matter was filed by convict Akash was listed before division bench of justice Sabina and Sushil Kukerja December 31. On December 6, the Division bench reserved its decision after hearing the arguments of defence and persecution in the death sentence awarded by the fast track Court Solan.
The death sentence was awarded to accused Akash, a resident of Uttar Pradesh. Accused was found guilty in the fast track trial and police investigation who first raped a 7-year-old innocent girl in 2017 and later strangled to death at Baddi, the biggest industrial area of the state.
In the investigation of the case, it was found that crossing the limits of brutality, a piece of wood was also inserted in the private part of the girl. On February 2022, a fast track court of Additional district and sessions judge Parvinder Singh Arora awarded death sentence to Akash Kumar a resident of Hardoi district of UP.
This was the first case under the Protection of Children from Sexual Offenses (POCSO) Act in Himachal Pradesh where a sessions court has sentenced a convict to death. District sessions judge Solan had declared this heinous and case of rarest of rare nature as court found the convict guilty under Section 302, 376 of IPC and Section-10 of the POCSO Act.
