A major political controversy has erupted in Himachal Pradesh after the Tissa Police Station in Chamba district registered an FIR against BJP MLA Hans Raj from Churah constituency, invoking serious charges under the Bharatiya Nyaya Sanhita (BNS) — marking one of the first high-profile cases in the state under the new law.
The FIR, filed on November 6 on the complaint of Taj Mohammed, alleges offences under Sections 140(3) (kidnapping or abduction for secret and wrongful confinement), 115(2) (voluntarily causing hurt), 351(2) (criminal intimidation), 324(4) (mischief), and 3(5) (common intention).
According to the complaint, Taj Mohammed and his daughter were allegedly forcibly taken to Shimla by the MLA and his associates. The complainant further claimed that his daughter was threatened with dire consequences and compelled to record a scripted video — purportedly aimed at misleading the public and authorities. The FIR mentions that both father and daughter were wrongfully confined and subjected to mental harassment during the episode.
Chief Minister Sukhvinder Singh Sukhu, responding to media queries on Thursday, said that an earlier FIR in the same matter had been cancelled by the court following a change in the victim’s statement. “Now, with a new complaint filed by the victim, the police have re-examined the matter. Further action will be taken strictly in accordance with the law after verification of facts,” the Chief Minister stated.
A senior police officer from Chamba confirmed that the case has been formally registered and is under active investigation. “We are recording statements of the complainant and his daughter. Necessary legal steps will follow based on the investigation’s findings,” the officer said.
Meanwhile, MLA Hans Raj has denied all allegations, terming them politically motivated. However, he recently faced public backlash after posting comments on social media about the victim — remarks that went viral and drew sharp criticism, particularly from youths working in the industrial township of Baddi. The controversy forced the legislator to issue a public apology.
The case has reignited debate in Himachal’s political circles over the conduct of public representatives and the independence of law enforcement agencies. Opposition leaders have called for an impartial probe, urging that no individual, irrespective of position or power, should be shielded from accountability.
The FIR against a sitting legislator under the Bharatiya Nyaya Sanhita has drawn statewide attention not only for its political implications but also for being among the earliest tests of the new criminal code in Himachal Pradesh.
