HC declared Vinay Sharma petition ‘infructuous’: DGP

In a press statement today, Himachal Pradesh Director, General of Police Sanjay Kundu said that the Himachal Pradesh High court had declared Vinay Sharma’s Civil Writ Petition infructuous. He said that the decsion came in light because the state government had already announced a CBI probe into the matter on May 18, 2022.
Advocate Vinay Sharma had filed a CWPIL (No. 34 of 2022) before the Himachal Pradesh High court, praying to hand over the case of paper leak in the Police Constables recruitment test to the Central Bureau of Investigation (CBI). Sharma, in the petition, had also requested a new written examination for the said posts to be conducted through H.P. Staff Selection Commission, Hamirpur.
After the initial hearing on May 12, 2022, Kundu informed that the Court listed this matter on May 26, 2022. On the same day petition filed by Vinay Sharma, Advocate, was disposed of based on contention filed by the DGP (himself). In Vide communication dated 25.05.2022, the Director-General of Police, Himachal Pradesh, informed the High Court that cases relating to the alleged paper leak during the recruitment of Constables in H.P. Police had been sent to CBI on 18.05.2022 by the Government of H.P. for further investigation.
“Based on this contention, the High Court rendered the petition infructuous,” confirmed the DGP in the statement. Adding, he said that the second prayer of the petitioner about the conduct of retest through H.P. Staff Selection Commission, Hamirpur was also disposed of by the High Court by holding that the petitioner has no cause of action to seek such relief from the Court, finally disposed of the petition.
