A legal notice has been served to Sanjeev Gandhi, Superintendent of Police, District Shimla, by Advocate Nitasha Katoch on behalf of MLA Sudhir Sharma of Dharamshala Assembly Constituency, District Kangra. The notice addresses allegations made by Gandhi during a recent press conference/briefing in Shimla concerning the Bimal Negi suicide case.
The notice refutes claims that MLA Sharma is a co-conspirator in the case or that his client’s business is linked to a pharmaceutical company allegedly financing a conspiracy. It states that all allegations are “totally preposterous and have been made… in the most reckless manner” without any basis or substantiation. The notice further clarifies that live streaming of proceedings at the Himachal Pradesh High Court, as mentioned by Gandhi, is allowed by the court itself.
Additionally, the legal notice emphasizes that live-streamed proceedings can be understood by anyone, regardless of their education. It asserts that the allegations made by Gandhi are irresponsible, scandalous, and defamatory, inviting action for intentional defamation under both civil and criminal law. The notice suggests that these allegations might be an attempt to please political benefactors.
The notice also points out that there was no occasion for Gandhi, as a police officer, to make such press statements against MLA Sharma, especially given the lack of evidence connecting him to the alleged suicide of Bimal Negi. It highlights that Gandhi has wrongly accused MLA Sharma as the main culprit in the Rajya Sabha Election despite his name not being mentioned in the FIR, which is contrary to the Bharatiya Nyaya Sanhita (BNS).
The legal notice demands that the Superintendent of Police issue an urgent press briefing and withdraw all unsubstantiated and irresponsible allegations against MLA Sharma within two days of receiving the notice. Failure to comply will compel MLA Sharma to initiate proceedings for redressal of his grievances in the competent court of law, with all litigation costs to be borne by Gandhi.
Noteworthy that two days after the High Court ordered CBI enquiry into the HPPCL deceased GM Vimal Negi case to CBI, SP Shimla in a media conference accused BJP MLA Sudhir Sharma of maligning image, and has filed a petition in the Himachal Pradesh High Court seeking action against him for allegedly circulating a video clip of the court proceedings held on May 21 without the court’s permission.
