Nishant Sharma matter: HC seeks complete litigation history before next hearing
Shimla, May 20,
The High Court of Himachal Pradesh has sought a detailed chronology of proceedings in the long-running Nishant Sharma litigation, observing that the matter has gone through multiple rounds of judicial scrutiny and remand proceedings before subordinate courts.
A Division Bench comprising Chief Justice G.S. Sandhawalia and Justice Bipin C. Negi passed the order while hearing connected criminal writ petitions, including Nishant Sharma vs State of Himachal Pradesh and Others.
During the hearing, the court took note of developments arising out of a complaint filed under Section 156(3) CrPC against Kamlesh Kumar Sharma and Nishant Sharma by respondent K.D. Shreedhar.
Referring to earlier proceedings before the Judicial Magistrate First Class (JMIC), the Bench recorded that the complaint “was disposed of on 2nd April, 2025 by coming to the conclusion that there was no prima facie case for the commission of offences.”
However, the High Court further noted that “Criminal Revision No.345 of 2025 filed by the complainant therein, namely K.D. Shreedhar, was allowed on 11th November, 2025.”
The Division Bench observed that after the revisional court set aside the earlier order, “the matter is now again pending for scrutiny before the JMIC, as the earlier order was set aside and the matter stood remanded and is now pending for fresh consideration.”
Noting the prolonged and layered nature of the litigation, the court directed filing of a comprehensive record of proceedings. The order states:
“Let a detailed list of events be filed, giving the history of the litigation along with page marking of the relevant documents.”
Counsel appearing for one of the respondents undertook to prepare the compilation and supply copies to all parties concerned.
The matter has now been listed for further hearing on June 25, 2026.
