The Himachal Pradesh High court heard the matter of suo moto Public Interest litigation in the Nishant case on Wednesday during which the State government informed the court that an IG level SIT has been constituted to probe the matter following the fresh order issued in the matter from supreme court which had upheld the order issued by the high court earlier to form a high level panel after involvement of DGP in the alleged case.
The matter was fixed for hearing before the Division Bench of Chief Justice MS Ramchandra Rao and justice Joyotsana Rawal Dua. The court has fixed the next date of hearing in the matter after four weeks. The counsel for the State and Advocate General Anup Rattan said that state submitted the Status report in the matter and informed the court that SIT has been formed with IG rank officer Abhishek Dullar and Santosh Patial on the directions issued by the high court on the previous hearing in the matter.
The Counsel for the complainant Neeraj Gupta informed that state has been directed to file status report after probing the matter in four weeks.
Background of case
This litigation started on November 11, 2023, when the High court took Suo moto notice of an October 28 email complaint filed by a Palampur businessman Nishant Kumar Sharma, alleging a threat to his life from influential individuals. In the complaint he had also accused the State DGP for the alleged criminal intimidation.

On Jan 9 HimachaL Pradesh has ordered the Principal Secretary (Home), State of HP n the said Cr.WP shall ensure effective protection to Nishant Sharma and family until further orders. Stating,” The State Government should form a Special Investigation Team consisting of IG level officers to coordinate the investigation in all the FIRs mentioned here and also to advise on providing adequate and effective security to Nishant Sharma and family.
