Shimla, Nov 7
Following the Supreme Court’s dismissal of the Himachal Pradesh Government’s challenge to the High Court verdict on contractual employees, the State Government has initiated the process of reviewing seniority lists and extending consequential service benefits to eligible employees in accordance with judicial directions.
The Department of Personnel, through a communication issued on November 6, has circulated detailed instructions to all administrative secretaries, divisional commissioners, deputy commissioners, heads of departments and public sector undertakings, corporations, boards and universities for implementing the court verdict.
The instructions follow the Himachal Pradesh High Court judgment dated April 25, 2026, in CWP No. 3361 of 2025, titled *Devinder Kumar and Others versus State of Himachal Pradesh and Another*, along with connected petitions. The High Court had quashed the Himachal Pradesh Recruitment and Conditions of Service of Government Employees Act, 2024, which had altered the service conditions and benefits of contractual employees.
The State Government had challenged the High Court judgment before the Supreme Court, but its Special Leave Petition was dismissed on July 29, 2026, leaving the High Court verdict undisturbed.
In its operative directions, the High Court had declared all consequential actions, omissions and decisions taken by the State authorities under the quashed legislation illegal and unconstitutional. It had further directed the competent authorities to ensure extension of benefits to employees in accordance with judgments passed by competent courts within three months.
Under the fresh instructions, concerned administrative departments have been asked to identify the applicability of judicial decisions to individual petitioners and initiate the process of circulating tentative seniority lists, finalising revised seniority and conducting review or fresh Departmental Promotion Committee (DPC) meetings wherever required.
The government has also specified the procedure for adjusting promotions arising from revised seniority after counting contractual service. In cases where an employee moves down in the revised seniority list, the earlier DPC through which the employee was promoted will be reviewed. Conversely, employees who become eligible for promotion at an earlier stage due to upward movement in seniority will be considered through fresh DPCs, subject to availability of vacancies and prescribed procedures.
However, the government has clarified that promotions will ordinarily take effect prospectively or from the actual assumption of charge of the concerned post. Monetary benefits arising from revised seniority and DPC proceedings will generally be calculated on a notional basis unless a competent court has explicitly directed payment of financial benefits from the date of eligibility.
The instructions further specify that no supernumerary posts will be created under any circumstances to accommodate the consequences of review or fresh DPCs. Final orders in such matters will require approval at the level of the Secretary of the concerned administrative department, failing which responsibility will be fixed on the concerned authority.
The government has also referred to the Supreme Court judgment dated August 11, 2026, in ‘State of Himachal Pradesh versus Jameet Sing’ regarding employees described as fence-sitters who did not approach the appropriate judicial forum at the relevant time. Their claims will be considered in accordance with the legal principles laid down by the Apex Court.
All consequential orders issued after regular, review or fresh DPC proceedings will remain subject to available legal remedies concerning the High Court judgment dated April 25, 2026.
The latest instructions provide an administrative framework for implementing the judicial verdict, particularly in matters involving counting of contractual service, revised seniority, promotions and consequential service benefits of employees who had secured relief through competent courts.
