Habitable attic floors: HP Government issues notification

The Himachal Pradesh Government has issued a notification to amend the town country planning rules, allowing habitable attic floors. The four-page notification, approved by the Himachal Pradesh Governor on May 31, 2023, amends the Himachal Pradesh Town and Country Planning Rules, 2014.
The amendment introduces sub-rules in the existing Rule 16 of the Himachal Pradesh Town and Country Planning Rules, 2014, which govern the construction of attic floors in planning areas.

According to the amended sub-rule (3)(a), in the case of habitable attic floors, the following fees will be levied in addition to the fees payable under Rule 16(2) for cases involving a premium Floor Area Ratio (FAR) of up to 0.25.
The fee for the area projection below the portion of the roof with a height of 2.1 meters or more (in square meters) in residential areas will be charged as follows:
Up to 40 square meters: Rs 50,000, 40-60 square meters: Rs 75,000, 60-100 square meters: Rs one lakh, For more than 100 square meters: Rs 1,000 per square meter. The rates for non-residential use, including real estate projects, will be 1.6 times the above rates, stated the government notification.
The notification states that the Development Plan or Interim Development Plan currently in force, as applicable to any planning or special area notified under the statutory provisions of the Himachal Pradesh Town & Country Planning Act, 1977, will permit habitable attic floors. However, a premium FAR of 0.25 will be allowed for habitable attic floors, and an additional fee as prescribed under Rule 16(3) will be payable. The attic must comply with the maximum permissible height of the building as provided by the regulations of the Development Plan or Interim Development Plan. The height of the sloping roof and the maximum height of the ridge at the center will vary depending on the proposed habitable attic.
Only the area with a clear height of 2.1 meters will be counted towards the Floor Area Ratio (FAR) for habitable attic floors.
The option of a habitable attic will be available for residential and all other uses, and a separate fee will be charged for each block.
The notification further specifies that the habitable basement will be considered as an independent storey.
The notification invites objections or suggestions from individuals who may be affected by these draft rules. Such objections or suggestions can be sent in writing to the Principal Secretary (TCP) of the Government of Himachal Pradesh, Shimla, within a period of thirty days from the date of publication of the draft rules in the Rajpatra (e-Gazette) of Himachal Pradesh.
The notification will come into force from the date of its publication in the Rajpatra (e-Gazette).
