The High Court of Himachal Pradesh has made scathing remarks on the sheer incompetency of Government servant, i.e. Tehsildar, Anni, District Kullu, which compelled a poor lady, Parvati Devi, to approach the High Court.
The facts of the case are that on 22.12.2022 Additional District Magistrate, District Kullu, passed an order in an appeal filed under Rule 19 of the Part Time Multitask Workers Policy specifically directing Tehsildar, Anni to re-verify the income certificate issued in favour of one Priyanka.
During the course of hearing the Court observed that more than one year and three months have elapsed, but the Authority concerned has not bothered to comply with the aforesaid order, which itself speaks volumes about careless and negligent approach of the officers manning the high post, towards welfare of general public as well as orders passed by the courts.
Justice Sandeep Sharma, while passing this order held that courts are being accused of huge pendency of cases but probably nobody has realized that pendency of cases in court of law is on account of indifferent and callous attitude of government officials, who instead of shouldering responsibility, not only keep on waiting for court orders, rather compel general public to approach court of law in every petty matter.
Additional Advocate General appearing for the Respondents assured the Court that the order in question shall be complied with expeditiously.
The Court further observed that though, it is a fit case where the court having taken note of serious lapse on the part of the officer concerned would have straightway initiated contempt proceedings against the officer, but on the vehement request of Additional Advocate General, deems it fit to dispose of the present petition with a direction to Tehsildar, Anni to comply with the order dated 22.12.2022, within 48 hours and submit compliance report to the Registry of High Court.
The Court directed the Additional Advocate General to place the copy of instant order before the Chief Secretary, Government of Himachal Pradesh, so that necessary directions are issued to all the departments to ensure compliance of orders passed by the Court/Quasi Judicial Authorities in a time bound manner.
