The Himachal Pradesh High Court has dismissed the anticipatory bail plea of Brijeshwar Kashyap, son of former BJP Member of Parliament from Shimla constituency, Virender Kashyap, in a rape case registered at the Women Police Station, Solan. The case pertains to allegations of sexual exploitation under the pretext of marriage.
The matter came up before Justice Virender Singh, where the State government opposed the plea, citing Supreme Court precedents which hold that the accused must first approach the Sessions Court for anticipatory bail before moving the High Court. Accepting this contention, the court held the petition to be invalid. The petitioner subsequently withdrew the plea, seeking liberty to file a fresh application before the Sessions Court.
According to the police, a woman has accused Brijeshwar Kashyap, a dentist by profession, of raping her repeatedly over two years on the false promise of marriage. The complainant alleged that the accused later refused to marry her on one pretext or another, leading her to file a complaint. Based on her statement, the police registered an FIR and initiated an investigation.
Superintendent of Police (Solan) Gaurav Singh confirmed that the complaint has been taken on record and a detailed investigation is underway. He stated, “The case has been registered following the victim’s complaint. Necessary legal action is being taken, and the matter is under investigation.”
Sources indicated that the accused is already married.
Meanwhile, Himachal Pradesh State Women’s Commission Chairperson Vidya Negi has taken suo motu cognizance of the case and directed the Solan police to ensure a fair investigation free from any political pressure. “The victim has alleged sexual exploitation under false pretenses. The Commission has sought a detailed report from the Superintendent of Police,” she said.
The case comes amid a spate of recent allegations involving individuals linked to prominent political families in the state, drawing attention to the need for strict enforcement of laws in cases of sexual violence.
