The Himachal Pradesh Assembly passed a new Himachal Pradesh Abadi Deh (Record of right) Bill 2021 to enable people of rural areas to use their properties as financial assets, creation of land records for rural planning and reduce legal cases and land disputes over Abadi land in rural areas.
Revenue Minister Mahinder Singh Thakur said that the legislation was introduced as Ministry of Panchayati Raj of Union government , has launched a central sector scheme titled ‘ SVAMITVA ‘ (Survey of Villages and Mapping with Improved Technology in Village Areas ) amongst others with the following objectives to record and resolve the existing rights of the proprietors within the area of Abadi Deh.
He said that objective of bill was to bring financial stability to the citizens in rural India by enabling them to use their property as a financial asset for taking loans and other financial benefits, to create of accurate land records for rural planning, creation of survey infrastructure and Geographic Information System maps that can be leveraged by department for their use.
Beside this, the minister said that it would help to support in preparation of better – quality Gram Panchayat Development Plans (GPDP ) by making use of Geographic Information System maps and to reduce property related disputes and legal cases.
The Abadi Deh area in Himachal Pradesh is not assessed for land revenue. This area has remained without recording of rights of the proprietors, preparation of record, or the marking of boundaries by carrying out a survey.
This has resulted in disputes about demarcation of boundaries and identification of rights in the dwelling and other areas; besides causing hardship in the effective transfer of rights.
The object of this Bill is to make a law to identify record and resolve the existing rights of the proprietors within the Abadi Deh by a process of ascertaining the person(s) best entitled to be recorded as proprietor; besides, demarcating, delineating the boundaries and areas of each survey unit. It also aims to create a presumption of truth in the records so prepared.
The preparation of this record would provide for development of the Abadi Deh (lal lakir) that preserves the heritage of the village to the extent possible, provide and upgrade civic services and environment in villages to integrate them with planned urban development, enhance the land value by improving the lay out and provide a road map for development norms for village in an easy and simple manner.
Minister said that goverment would also consider the proposal of Member to also record the nator land other plot of land to its owner which is not recorded on their names sofar.
CPI(M) MLA Rakesh Singha demanded that on the analogy of Abadi Deh land such land which is alloted to the people as Naotar land and not recorded in revenue record in the name of allotee should also be included in the new law. The house approved the bill unanimously without any opposition in the house with voice votes.
