Himachal Pradesh Government has notified the cabinet decision to allow open to sky parking for building located near valley side/hill side in the Civic bodies of state by inserting an additional rule in the Town and Country Planning Rule 2014.

A notification issued by the Secretary town and country planning on Dec 4 stated that an additional rule (31) was notified by the Gazette notification which would come in force with its publication.
The new rule maintains ‘‘for all buildings located on valley side or hill sides of the roads and having minimum clear setback of two meter within the plot, after the controlled width or retaining wall and having clear access from the road, open sky parking (uncovered and parallel to the building) on 50 per cent frontage of such setback shall be permissible.”
”In case of building on the valley side the owner shall be permitted to construct a temporary steel frame structure/ ramp on 50 per cent frontage of such setbacks for open sky parking. ”
” The temporary parking platform so proposed should be see-through or perforated or meshed (not solid sheet) in order to have sufficient gaps or spaces for light and ventilation and should not obstruct any disaster management efforts and smooth flow of traffic on the abutting road and should be duly certified by a registered structural engineer.
The state government notification is likely to have limited benefit to a section of civic residents however notification is being issued in light of National Green Tribunal Verdict and Himachal Pradesh High Court order, which imposed number of restrictions on the construction and regulation rules in the TCP and special planning areas.
