Central Bureau of Investigation today stated in the court that Doxy Nucleic Acid (DNA) report of the accused in ‘Gudiya’ rape and murder case confirms his involvement in the crime. This was stated by the CBI counsel while arguing the main case here today.
The case was listed for the final hearing and argument on Apr 16 in the court of Session Judge Rajiv Bhardwaj and the counsel for the defense and prosecution argued over the credibility and reliance over sampling and testimonies collected by the Central agency.
Defence counsel Mahinder Singh Thakur said that CBI came up with the doubtful samples in the case which were taken before the arrest of accused Neelu. Thakur said that CBI also kept the seal of the samples with its possession. He alleged that CBI seemed booked and involved accused Neelu to save someone in the case.
However arguing over the veracity of the samples collected by the agency CBI counsel stated that the agency had collected the samples of DNA of the accused which had confirmed the involvement of the accused.
Defense counsel argued that the matter on the six points related to the crime and questioned the haste of CBI to prejudge the involvement of the accused before his arrest. The court fixed the next date of hearing on Apr 28 in the matter .
On the afternoon of July 4, 2017, a 16-year-old Class 10 student in Shimla’s Kotkhai area left her school but never reached home. Amidst an ongoing sports tournament in the school, her brother and other schoolmates who usually accompanied her stayed back and she decided to walk to her house alone – a 1.5-hour journey on foot, which included trekking through a forest.
Two days later, her body was found in a ditch in the forest, with her clothes, an empty liquor bottle, and some other items scattered around her.
An autopsy indicated that she died due to the cumulative effect of “homicidal smothering and manual strangulation in a case of recent forcible penetrative sexual assault”. In layman’s language, she was raped and murdered.
The incident triggered massive protests and uproar in Kotkhai, Shimla and other parts of the hill state where crimes of such nature are rare.
