Driver jailed for rash driving conviction by Theog court

In a rare instance where a rash driving case resulted in imprisonment rather than being disposed of with a monetary penalty, the Court of Additional Chief Judicial Magistrate (ACJM), Theog, has convicted and sentenced a motorist to jail for endangering public safety on a road in Shimla district.
The case pertains to FIR No. 65 of 2018, registered on April 9, 2018, at Theog Police Station under Sections 279 and 337 of the Indian Penal Code and Section 181 of the Motor Vehicles Act.
In many such cases, accused persons escape with fines or other minor penalties. However, after a full trial, the court found sufficient evidence to award a custodial sentence.
According to police, accused Gopal Singh was charged with driving a vehicle in a rash and negligent manner on a public road, thereby endangering human life and causing injuries.
During the investigation, police collected documentary and oral evidence, which was subsequently presented before the court.
The prosecution successfully proved the charges beyond reasonable doubt through witness testimonies and material evidence. After examining the record, the court held the accused guilty of the offences charged.
The court sentenced Gopal Singh to three months’ simple imprisonment and imposed a fine of Rs 500 under Section 279 IPC. He was also awarded three months’ simple imprisonment and a fine of Rs 500 under Section 337 IPC.
Additionally, he was sentenced to one month’s simple imprisonment and fined Rs 500 under Section 181 of the Motor Vehicles Act for driving without a valid licence. In case of default in payment of the fines, the convict will undergo additional imprisonment as prescribed by law.
Police officials said the conviction reflects the commitment of the Himachal Pradesh Police to enforcing road safety laws and holding reckless drivers accountable.
They appealed to motorists to follow traffic rules and drive responsibly to prevent accidents and safeguard lives.
