The Municipal corporation Shimla (SMC) has been issued legal notice for issuing No Objection Certificate’ (NOC) to allow electricity and water connection to the controversial DLF ‘Sama Tara’ project. The matter took light after Himachal Pradesh Jai Ram Thakur Government issued a completion certificate to DLFÂ (Bemloe builder) project this year. The construction firm (Bamloe builder ) remained in thick controversy during the last Dhumal regime. As per papers in possesion of HimachalScape the DLF Home project is about to be handed over to customers soon.
Senior Advocate of Himachal Pradesh High court Sanjeev Bhushan and Advocate Rajesh Kumar served notices (Copy of which is with Himachalscape) to Commissioner of Shimla Municipal Corporation(SMC) under sec 90 of CPC alleging that ‘No Objection Certificate’ (NOC) to allow electricity and water connection to this project is against the interim order of Pending Public Interest litigation.Â
The petitioner alleged that SMC violated the court direction in the matter as it was restrained by the court for granting NOC with respect to water and electricity connection to the said builder in questions. Petitioner said that a restrained order was passed by a clear cut rider.Â
The counsel for the petitioner said in the notice that SMC has violated the court interim order passed in 2011 (8945/2011) as the Town and Country planning could not offer Completition Certificate to the alleged firm without providing permission to install Water and electricity connections.Â
The advocate also charged the respondent SMC and TCP that they have done this collusively with the Builder and the action is malafide and is taken on extraneous reasons.
The notice also alleged underhand deals with the builders because of which CC has been issued. Terming the decision astonishing on part of SMC the counsel said that the decision clearly amounts to contempt of the orders passed by the High court. The notice also questioned the issuing of CC to the builders without providing permission to offer water and electricity connections.Â
The counsel for the petitioner in the matter sought to immediately withdraw the CC issued in favour of Bamloe construction further warning the SMC to charge the Rs 21000 cost of this notice.Â
DLF Homes Panchkula Pvt ltd was offered CC by the Department of Country Planning of HimachalPradesh Government vide letter number 9765-67 dated Feb 3, 2020. Based on it the firm informed its customers that it was about to begin the handover of the project.
The firm also mentioned that it has received an official certificate(OC) for alleged Villa and are in the process of issuing Offer of Possession (FSA) as the team has already started the process. The firm has claimed that the same is most likely to happen in the month’s time however exact time of FSA release is not in its hands.Â
Letter was dedicated to the DLF customers by Head Customers Service Manish Verma of DLF Homes Panchkula Pvt ltd.Â
This developments is likely to rock the political milieu of the state and oncoming Vidhan Sabha Session as the Opposition Congress and CPI(M) have been targeting the BJP governments for offering largesse to the alleged firms violating environmental norms. Former Dhumal Government remained under the target of opposition as the
road was built overnight and project allowed amid thick Deodar forest in the Shimla town.  Â
