Defying court order HC issues contempt notices to HP Secy home
Shimla, May 4
Himachal Pradesh High court today issued notices to Principal Secretary Home, Deputy District Attorney Excise and Taxation, Kishan Singh Verma and Additional District Attorney Shweta Sadyal for defying court order.
The order was passed by Division bench of Acting Chief Justice Tarlok Singh Chauhan and Justice Virender Singh today stated that in Prashant Singh vs. State of H.P. case, the bench had passed that DDA and ADA did not join their duty defying its earlier order.
Court said that the State cancelled the transfer order of Kishan Singh Verma, DDA, and Shweta Sadyal, ADA in utter defiance to the orders passed by this Court. Therefore, notice of contempt issued to the Principal Secretary (Home) to the Government of Himachal Pradesh; and Kishan Singh Verma, DDA, office of Commissioner, State Taxes &
Excise, Shimla and Shweta Sadyal, ADA, office of HPPCL, Shimla, to be served upon them through the Director Prosecution.
Till then, both Kishan Singh Verma, DDA and Shweta Sadyal, ADA are restrained from joining at their respective place of posting(s) and in case, they have joined, they are restrained from performing any duties.
Bench observed that Court has come to a grinding halt only because for want of the Deputy District Attorneys and ADAs not joining or for want of appointment, even despite the orders passed by this Court in CWP No. 1930 of 2020.
Court fixed next hearing in the case on May 9, 2023 for compliance of court order.
