Himachal Pradesh High court observed that Shimla Municipal Corporation has marked yellow lines to park vehicles on the congested road at Boileauganj in Shimla town against the court order. Passing this order on Thursday the single bench of justice Tarlok Singh Chauhan directed the SMC Commissioner Pankaj Rai to visit the spot to remove the yellow lines in his personal presence.
The court passed this order on Oct 15 as the Amicus Curiae Jagdish Thakur pointed out that the SMC has carved out yellow lines at various places in the city in an unorganized manner without taking into account the narrowness of the passage.
Court said in a three paged order released to media today that recently, yellow lines have been marked for creating parking space near main gate of the Police Station, Boileauganj, in the main market, which is needless to say is creating problems of traffic congestion in the Boileauganj market.
”Such marking of yellow lines in unorganized manner on the narrow points is contrary to the directions passed by this Court from time to time, the Amicus Curiae pointed out.
The court directed the Commissioner of SMC To personally visit the Boileauganj market and ensure that all the yellow lines drawn are removed immediately and fresh yellow lines only in those places where there is free flow of traffic on both sides of the road, are drawn.
The bench also held that there should be no hindrance to the movement of vehicles to and fro in the Boileauganj market and no yellow line would be drawn near the bus stop and the same be removed forthwith.
The court also directed the Commissioner to depute an official not below the rank of Junior Engineer, so as to identify all such bottlenecks within the Municipal Corporation area of Shimla where the yellow lines have been drawn. The court also issued notices to Deputy Commissioner Shimla Amit Kashayap about non compliance of court order regarding transfer of land ( measuring 00-35-65 hectares) for relocating the automobiles repair or denting painting shops in Transport Nagar.
The court ordered the SMC Commissioner and DC to submitted the compliance report about its directions on or before the next date of hearing fixed on Nov 6, 2020.
