A private university of Himachal Pradesh was found guilty by the HP Pvt Education Regulatory Commission indulged in unforgiving activities and suppression of the facts, was slapped with penalty Rs three lacs fine and seeking the UGC to quash degrees obtained of its four employees. This matter came to light through an order by Major General Atul Kaushik, Chairman HPPERC and Prof. Shashi Kant Sharma, member of the same.
In the matter the respondent private university namely Indus International has been found guilty of a major anomaly. Just for the sake of their short gains, “Indus International University , Una , HP has spoiled the sanctity, secrecy of the examination system and degraded the values and ethics in quality education,” spelled out the extracts of an inspection report about the institution.
In the matter the Commission received a complaint from the Petitioner through an email and mainly raised three irregularities of Indus International University, Distt. – Una , H.P .
The complaint raised the doubt on the qualification of Vice – Chancellor. In the matter of fake degree related to Lekh Raj (HOD Civil Engg.) Commission found that degree awarded to four employees namely, Kulwinder Kaur, Jagriti, Shilpa Thakur and Sanjeev Dhiman.
In the matter the issue of qualification of Vice chancellor of respondent namely Dr. Subramanian Raman Iyer was dealt by the Commission and in compliance of the direction issued in Nov 11.11.2020. They removed Subramanian Raman Iyer from the post of Vice – Chancellor and for the remaining issue Commission constituted an inquiry or inspection committee on 10 06-2021.
On the basis of inquiry report and document submitted by both parties, the Commission observed that the Bio data submitted to the Respondent University by Lekh raj clearly shows that his teaching experience as an Assistant Professor from Global Group of Institute is contradictory to the period as he obtained the M.Tech Degree from Manav Bharti University Solan. One individual cannot be present at different places at one time, the commission established.

Adding, “The Respondent University could not produce any document on record which shows that Indus University has got approval from any regulatory / affiliating body through which they can allow their full time non – teaching employee for pursuing full time regular degree ( M.Tech and MBA ) simultaneously”.
Also,” Documents clearly shows that the erstwhile Registrar of Indus University has claimed SC / ST scholarship of their full time regular employee namely Sanjeev Dhiman by showing him a regular student of M.Tech Program. During this tenure , Sanjeev Dhim drew a salary from the Indus University for his service as an employee,” stated the commission in the order.
Further adding that,” It is also found that the then Registrar has also awarded a fake certificate to Kulwinder Kaur on 28/09/2018 for Government job. As per the record she was working as Assistant Examination department of Indus University since her appointment from 14-12 2012 till 9 – April – 2016 . But the University authority issued an experience mentioning that she worked as Assistant Professor in the Computer Science department in Indus University from 17 12-2012. This certificate was issued to Kulwinder Kaur so that she can apply for any Govt job,” found the HPPERC through its enquiry report.
In the order for justice, the commission stated that” the matter related to the fake degree of Lekh Raj is already before the Honorable High Court in CWP No 888 of 2020.
The matter related to quashing of degree of four employees namely Kulwinder Kaur , Jagrit Kaul , Shilpa and Sanjeev Dhiman be forwarded to the University Grant Commission as the HP – PERC lacks the jurisdiction,” it added.
Stating further,” the matter related to scholarship claimed by the then Registrar Indus University for Sanjeev Dhiman be forwarded to Director of Higher Education, Shimla and Director General of Police, HP for further inquiry and appropriate action.
Also the matter of fake experience certificate issued to Kulwinder Kaur was forwarded to UGC and Director of Higher Education for appropriate action, by the HPPERC.
Further adding that,” It is also found that the then Registrar has also awarded a fake certificate to Kulwinder Kaur on 28/09/2018 for Government job. The Commission also requested Director General of Police, Himachal Pradesh to direct Una Police to re-investigate in FIR 67/2020 lodged against Indus University by Asutosh at Police Station, Horoli, Distt. – Una and facts and findings of this Commission must be taken into consideration in this FIR.
Substantially and in its jurisdiction, providing justice, while regulating the institution for the work it does, the commission imposed a penalty on the university with mere Rs three lacs.
